Tax charges against former MP discharged, but company fined

Former Mining Minister and Braddon MP Adam Brooks has avoided penalty on tax evasion charges, but the company of which he was sole director, has been fined $5000.

Brooks has previously pleaded guilty in the Devonport Court, to one count of failing to comply with a requirement under Federal taxation laws by not lodging tax returns in 2019 and 2022.

He had also pleaded guilty as sole director of Rapid Fleet Management to three charges of lodging business activity statements between 2016 and 2022.

The court was told the paperwork had been finalised with the Tax Office last year and Brooks issued a refund of more than $81,000.

Magistrate Duncan Fairley found Brooks was enduring substantial, stressful, and emotional circumstances when he offended and discharged the individual tax evasion charge.

However, Mr Fairley said the same could not be said for Rapid Fleet Management, convicting and fining the company $5000.
